Fire risk assessment London legal obligations of landlords

In London, landlords are legally obligated to conduct thorough Fire Risk Assessments (FRAs) to ensure the safety of their properties and occupants. These legal obligations are outlined in various regulations and guidelines, emphasizing the critical role landlords play in preventing and managing fire risks. Here are key legal obligations for landlords in London regarding fire risk assessments:

  1. Regulatory Reform (Fire Safety) Order 2005:

    • Landlords are subject to the Regulatory Reform (Fire Safety) Order 2005, which places the responsibility on them to conduct regular fire risk assessments in residential and non-residential properties.
    • The assessment must identify potential fire hazards, assess the risk, and implement measures to reduce or eliminate those risks.
  2. Housing Act 2004:

    • Under the Housing Act 2004, landlords are obligated to provide and maintain housing in a state that is safe and free from health hazards.
    • This includes ensuring that fire safety measures are in place and that the property complies with relevant fire safety regulations.
  3. The Building Regulations 2010:

    • Landlords must adhere to The Building Regulations 2010, which includes specific requirements for fire safety in new and existing buildings.
    • Compliance with these regulations is essential to guarantee that the design and construction of the property meet prescribed fire safety standards.
  4. Gas Safety (Installation and Use) Regulations 1998:

    • Landlords are also subject to the Gas Safety (Installation and Use) Regulations 1998, which mandate annual gas safety checks by a Gas Safe registered engineer.
    • Gas appliances and flues must be maintained in a safe condition to prevent the risk of fire or gas leaks.
  5. Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020:

    • As of 1st April 2021, landlords in England, including London, must comply with the Electrical Safety Standards in the Private Rented Sector Regulations 2020.
    • Electrical installations in rental properties must be inspected and tested by a qualified person at least every five years.
  6. Tenancy Agreements:

    • Landlords should clearly outline fire safety responsibilities in tenancy agreements. This includes informing tenants about emergency procedures, escape routes, and the location of firefighting equipment.
  7. Regular Review and Updates:

    • Fire risk assessments should be regularly reviewed and updated. Any changes in property layout, occupancy, or regulations may necessitate modifications to fire safety measures.

Failure to comply with these legal obligations can result in serious consequences, including fines and, in extreme cases, imprisonment. Landlords are strongly advised to stay informed about the latest regulations and work proactively to maintain a safe living environment for their tenants in London.

Super Fast Service

We needed the FRA done for our new building urgently. Called their customer service around 11am and they arranged someone to be on site in the evening around half 6 same day. Although we had to pay extra for getting this arranged but it was worth. Time was more important for us than the money. Received the report within 48 hours too. Saved us from a big trouble. Definitely be using them again for new projects. Thank you
